Abuses of the Federal Notice-and-Comment Rulemaking Process

Abstract
The Senate Committee on Homeland Security and Governmental Affairs' Permanent Subcommittee on Investigations conducted an investigation into the "notice-and-comment rulemaking" process of developing and updating federal regulations after the service had been abused by commenters submitting a variety of problematic comments. Along with interview of agency personnel, the subcommittee surveyed fourteen agencies and their processes for receiving and posting comments including the CFPB, CFTC, SEC, EPA, and FCC. The Subcommittee found that most federal agencies lacked the appropriate processes to address the variety of issues the "notice-and-comment rulemaking" has experienced.
